Amilton Ferreira is a senior associate in the labor practice of Tauil & Chequer Advogados in the São Paulo office. He has been working in the labor area for 15 years, advising clients in the definition of highly complex case strategies in various segments of the industrial, trade, health and financial sectors. The professional has expertise in strategic litigation, consultancy, due diligence processes (IPO and M&A), negotiation and conflict resolution through conciliatory measures, and in the contractual and accounting areas.
His experience in strategic labor litigation includes the defense of clients in individual and collective lawsuits, public civil actions (“ACP”), administrative procedures involving the Labor Prosecution Office (“MPT”) and Regional Labor Secretariats; negotiation of Conduct Adjustment Terms (“TAC”) with MPT; filing of actions for annulment of infraction notices, as well as the review of labor calculations.
His work in labor consulting includes the elaboration of a profit and results sharing plan; advice on executive compensation, as well as on issues related to workers' health and safety; elaboration of memoranda on labor issues, labor contracts, retention, confidentiality, non-competition and non-solicitation, provision of services, among other contractual modalities and advice on the dismissal of workers.
In labor due diligence processes (IPO and M&A), he has experience in analyzing and indicating the risk factors involved in the transactions; analysis of procedural contingency reports; analysis of labor certificates; validation of risk forecasts; analysis of Conduct Adjustment Terms (“TAC”), as well as the preparation of opinions on labor issues addressed in the transactions.
As for his experience in negotiating and resolving conflicts through conciliatory measures, he worked in the structuring, implementation and management of projects of strategic cases settlements and in supporting clients in defining amounts to propose settlements based on the analysis of procedural risk.
